Suit still pending in local case pitting roadwork vs. health A federal wrongful death lawsuit remains pending against the Athens County Engineer over road maintenance work on Dutch Creek Road that the litigants say poses a mortal threat to a resident with chemical sensitivity. Each side recently filed updated complaints or answers in the case. The lawsuit was originally filed last year by Bob and Cindi Madej in opposition to county Engineer Jeff Maiden’s plan to chip and seal Dutch Creek Road east of Athens. Chip-and-seal is a standard maintenance strategy to make county roads smoother and less dusty. In September 2015, Athens County Common Pleas Judge Patrick Lang granted an injunction against the office of Athens County Engineer Jeff Maiden barring it from proceeding with the roadwork. This was due to chemical-sensitivity health concerns of Dutch Creek Road resident Cindi Madej.
